§ 1 Scope and provider
(1) These terms govern use of the service available at listrune.com (“Listrune”). The provider is the party named in the Imprint.
(2) Differing terms of the user do not become part of the contract unless we expressly agree to them in text form.
§ 2 What the service is
(1) Listrune is a tool for preparing trading-card listings. It looks cards up in publicly available databases, determines market prices, applies the pricing rules you choose, and produces CSV files in the formats used by eBay File Exchange and the Cardmarket stock import.
(2) Listrune does not list anything and does not sell anything itself. Uploading the generated files, and every contract with a buyer that follows, happens in your own name and on your own marketplace account.
(3) Prices come from third parties, in particular Cardmarket and TCGplayer, and are by their nature snapshots. They are reference points, not a guarantee of an achievable sale price. The price you actually set is your responsibility.
(4) The feature set keeps developing. Features described on the website as planned or “coming soon” are not part of the contract.
§ 3 Formation of contract, account
(1) The user agreement is formed when you create an account. For a paid plan, the contract is formed when the payment process completes.
(2) You must give accurate details when registering and keep your credentials secret. If you suspect unauthorised use, please tell us immediately.
(3) An account is for use by one person or one business and must not be passed on to third parties.
§ 4 Prices, allowances and payment
(1) The prices shown on the website at the time the contract is formed apply. All prices are in euros and include statutory VAT where such tax applies.
(2) Each plan includes a monthly allowance of AI photo scans. Each photo submitted to the AI scanner counts, including retries and photos that cannot be identified. Searching, adding cards manually, pricing and repricing do not consume this allowance. Once it is used up, further AI photo scans are unavailable until the next calendar month; other included plan features remain available.
(3) Payment is made in advance through our payment provider Stripe. If a payment fails, we may suspend access temporarily after an unsuccessful reminder.
(4) We will announce price changes in text form at least six weeks before they take effect. You may terminate the contract with effect from the date of the change.
§ 5 Term and cancellation
(1) Subscriptions run for an indefinite period and renew for the billing period you chose.
(2) Either side may cancel at any time with effect from the end of the current billing period. Cancellation is available in the application under “Billing” and informally by email.
(3) The right to terminate for good cause is unaffected.
(4) After the contract ends you can still export your data for 30 days; after that we may delete it.
§ 6 Right of withdrawal for consumers
Withdrawal notice
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise it, you must inform us by a clear statement — an email to support@listrune.com is enough. Sending the statement before the period expires is sufficient to meet the deadline.
Effects of withdrawal. We will refund all payments received from you without undue delay and at the latest within fourteen days of receiving your withdrawal, using the same means of payment you used. You will not be charged any fee for this refund.
Early expiry. If you expressly request that we begin performance before the withdrawal period ends, and confirm that you understand you lose your right of withdrawal on full performance, the right expires once performance is complete. If we begin early at your request, you owe a proportionate amount for the period used up to withdrawal.
The right of withdrawal applies only to consumers within the meaning of § 13 of the German Civil Code. Anyone using Listrune in the course of a trade, business or profession has no right of withdrawal.
§ 7 Your obligations
(1) You undertake not to use Listrune in order to
- breach applicable law or the rules of the marketplace in question,
- offer counterfeit or stolen goods,
- describe cards with knowingly false condition or language details,
- query the service automatically at a scale that impairs its operation.
(2) Complying with the rules of eBay, Cardmarket and other platforms, and with your own tax and trade-law obligations, is entirely your responsibility.
(3) In the event of serious or repeated breaches we may suspend access and terminate the contract for good cause.
§ 8 Availability
(1) We aim for high availability but do not owe any particular uptime figure. Maintenance, faults, and outages at the card databases and marketplaces we rely on can cause interruptions.
(2) If third-party price sources go down or change their interfaces, individual features may be temporarily limited. If a significant limitation lasts more than seven consecutive days, we will refund the proportionate amount.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee given.
(2) For slightly negligent breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — liability is limited to the foreseeable damage typical of this type of contract.
(3) Liability is otherwise excluded. This applies in particular to lost profit and to damage arising because a generated file is rejected by a marketplace, or because a card is listed at a price you did not check.
(4) You remain obliged to check the generated files before uploading them.
§ 10 Changes to these terms
We will announce changes in text form at least six weeks before they take effect. If you do not object before they take effect, they are deemed accepted; we will point this consequence out separately in the announcement. If you do object, either side may terminate with effect from the date of the change.
§ 11 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection provisions of the country of their habitual residence remain unaffected.
(2) The European Commission provides a platform for online dispute resolution. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
(3) Should any provision be invalid, the validity of the remaining provisions is unaffected.
